GrappLink Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the GrappLink mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

GrappLink is a training application designed for Brazilian Jiu-Jitsu practitioners and martial artists. The App provides:

• Video recording and review of training rounds
• Video clipping and annotation tools
• Training statistics and progress tracking
• Gym membership and community features
• Apple Watch companion for round tracking

3. User Accounts

3.1 Account Creation

To use certain features, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Promptly update any changes to your information
• Accept responsibility for all activities under your account

3.2 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in prohibited conduct.

4. Gym Membership

Some features require association with a participating gym. Your gym may have additional terms and policies regarding:

• Access to gym-recorded footage
• Sharing of training data
• Use of gym facilities

Please review your gym's policies separately.

5. User Content

5.1 Your Content

You retain ownership of content you create, including videos, annotations, and training notes. By uploading content, you grant us a license to store, process, and display your content as necessary to provide the service.

5.2 Content Guidelines

You agree not to upload or share content that:

• Violates any laws or regulations
• Infringes on intellectual property rights
• Contains harmful, offensive, or inappropriate material
• Includes personal information of others without consent
• Could harm minors in any way

5.3 Recording Consent

When recording training sessions, you are responsible for obtaining consent from other individuals who may appear in your recordings. Respect the privacy of your training partners.

6. Intellectual Property

The App, including its design, features, and content (excluding user content), is owned by GrappLink and protected by intellectual property laws. You may not:

• Copy, modify, or distribute the App
• Reverse engineer or decompile the App
• Remove any proprietary notices
• Use our trademarks without permission

7. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You will not:

• Use the App in any way that violates applicable laws
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the App or servers
• Use automated systems to access the App without permission
• Impersonate any person or entity
• Harass, abuse, or harm other users

8. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect and use your information.

9. Disclaimers

9.1 Service "As Is"

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 Training Activities

GrappLink is a training tool, not a substitute for professional instruction. We are not responsible for any injuries that may occur during training activities. Always train safely and within your abilities.

9.3 Third-Party Services

The App integrates with third-party services (Firebase, Google, Apple). We are not responsible for the availability or performance of these services.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GRAPPLINK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify and hold harmless GrappLink and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the App or violation of these Terms.

12. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes through the App or by email. Your continued use of the App after changes become effective constitutes acceptance of the modified Terms.

13. Termination

You may stop using the App at any time. We may terminate or suspend your access at any time for any reason, including violation of these Terms. Upon termination, your right to use the App ceases immediately.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in class action lawsuits.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and GrappLink regarding the App.
